Hosting a party?

Duty of care is a duty to do everything reasonably practicable to protect others from harm.

As the host of the party you have a duty of care to provide a safe environment for your guests. So plan your party and establish strategies you can use to monitor the party.

Remember: The host may be legally liable if a drunken guest causes damage to property or another person.

So as a host, please ensure excessive drinking does not occur as it is easier to stop your guests getting intoxicated than dealing with the situation later.

Drink Driving

Drink driving is a factor in around 20% of all fatal crashes in NSW. The fact is no matter how much you drink, alcohol slows down your reactions and decision-making skills, making driving more dangerous.

The best way to make sure you’re not tempted to drive after a few drinks is to leave your car at home.

  • Arrange transport before you go out, and leave your car at home.
  • Get to know your local bus service and taxis in advance.
  • Arrange overnight accommodation.
  • Arrange a friend or relative who is not drinking to give you a lift.

Register your party

Successful parties are often well planned. It’s up to you to provide a safe environment for your guests.

The NSW Police have developed a safe party pack that gives excellent tips on how to plan a safe and enjoyable party.

Register your party with the local police, as they can help make sure things run smoothly around your area on the night and will be prepared for any problems if they do occur.

Under 18’s

If you are holding a party for teenagers under 18 in your home, you are responsible and liable for the outcome.

  • If you decide to allow alcohol at your party, nominate a parent or responsible adult to control and monitor the serving of alcohol.
  • You are responsible for informing the parents of teenagers attending your party that alcohol will be available.
  • Arrangements should be made to ensure adult supervision of the party. Parties beside a pool or near the beach pose additional safety and supervision considerations.
  • Always provide lots of alternative non-alcoholic drinks as an alternative to alcohol for minors.

Party Crashers

Gatecrashers can be discouraged by:

  • Inviting people by personally handing out invitations.
  • IIncluding an RSVP on the invitation, so you are aware of who is attending and guest numbers.
  • Having a definite start and end time.
  • Using one exit and entry point, with a responsible adult at the door.
  • Not allowing guests to continually leave and come back to the party.
  • Avoiding sending SMS invitations and promoting your party over the Internet.
  • Hiring security if it is a large party.
  • Restricting the size of the party.
  • Registering your party with the local police.

Find out about local noise regulations, by contacting your Council or local police.
